OpenStreetMap data is not yet licensed under the Open Database  
Licence. The Creative Commons CC-BY-SA licence currently applies.

Neither licence discriminates against commercial use provided that you  
comply with the terms of the licence.

I'd suggest that you ask on the OpenStreetMap legal-talk mailing list  
for OSM-related questions.
