Wikimedia Commons has literally millions of pieces of content with
PD-mark-style copyright status declarations, and to the best of my
knowledge, no user has ever been sued over them (though of course some of
the declarations have been wrong and the content has come down after new
facts have come to light). So the amount of bravery required may not be so
much in practice, assuming you're willing to adjust your position if
appropriately challenged.
