No, see my comment after the article. This is a classic example of #openwash
-- calling something that's free (as in free beer) open.
Perhaps OKFN can afford some #opendata police with it's new-found riches ;-)
Another example is the Dept of Business Innovation & Skills consultation

There's a sidebar about open data which doesn't once mention the open
licence, and in fact as far as I can tell, there's no intention of opening
up company data (i.e. publishing under an open licence).
