afaik it was transposed and is in force. the problem is with the enforcement
of it, which is basically non-existent.

huh, parts of the pre-existing legislation on this page, have been rewritten
lately by the new government. as the legislational frenzy here affected most
laws in the last years, i'm actually unsure if the "new legislative
instruments" are not also affected by this.
