created by Google partnerships in the US.
3. One element not discussed in the statement is the desire of some r=
epositories to generate an ongoing revenue stream from the digitized public=
domain. I have not seen, for example, any indication that the British Lib=
rary is ever going to make its public domain newspapers freely available, b=
ut prefers to get royalties from Gale Cengage. In the US, libraries such a=
s the American Antiquarian Society and the New York Historical Society are =
generating large income streams from their partnerships with commercial ent=
ities. The very interesting article from the KB that you recently brought =
to the attention of the list stressed the responsibilities of public/govern=
ment organizations to make their holdings freely available. Would you say t=
hat the same principles (and your guidelines) should apply to private insti=
tutions as well? (FYI, I have argued this, but it has met with resistance.=
) Or are your guidelines intended just for public institutions?
4. You state that no one should claim copyright over copies of digiti=
zed public domain materials, but it is unclear to me whether this is becaus=
e you think that no copyright exists in the material (i.e., no originality)=
, or if it is a matter of principle.
5. I am surprised that your statement is silent on the 25 years of co=
pyright that is granted in the EU to the first publisher of an unpublished =
public domain item. Isn=92t this conversion of material from the public do=
main one of the biggest threats? Similarly, there is no mention of the Fre=
nch law giving libraries and archives control over reproductions of public =
domain items in their collections.
6. Lastly, one of my favorite clauses in the ARL guidelines on digiti=
zation agreements is the requirement that commercial partners protect the p=
rivacy of users of the digitized material. Perhaps you do not need it becau=
se European data protection and privacy is so much stronger than in the US,=
but it might be worth mentioning.
