Xnet, junto con las otras organizaciones de la sociedad civil europeas en la lucha por
asegurar la defensa de la Neutralidad de la Red en el marco de las políticas digitales de
la Unión Europea, denuncia el papel de vasallo de los lobbies de las telecos de muchos
gobiernos. En nuestro caso el papel que está desepeñando el gobierno español por mano de
Pilar del Castillo, rapporteur del parlamento sobre este tema.

Al  ser una rapporteur española, nuestra responsabilidad es todavía mayor a la hora de
presionar desde la sociedad civil, para que se defiendan los intereses de la ciudadanía y
de la innovación y no los cuellos de botellas creados por y para los grandes monopolios.

Como viene siendo habitual en el ámbito de legislaciones relativas a la era digital, la
posición de España con el PPSOE - y más con el PP en mayoría absoluta -, es contraria a la
Neutralidad de la Red, defendiendo puntos de vista anacrónicos y cortoplacistas que
básicamente representan la postura e intereses de Telefónica. Aquí puedes leer más

Hace tan solo un mes celebrabamos en las redes la victoria histórica, tras años de presión
ciudadana, la decisión de la FCC de blindar legalmente la Neutralidad de la Red en Estados
Unidos, lo que significaba que internet pasaba a ser considerado un bien público y que
ninguna corporación o gobierno tiene derecho a priorizar o no quien tiene acceso a ella.

No podemos consentir que en Europa se haga justo lo contrario.

Mientras la reciente apuesta de Estados Unidos por la defensa de la Neutralidad de la Red
les asegura estar a la vanguardia del desarrollo de una economía online abierta, una
legislación europea que permita la priorización por pago atenta contra los derechos de los
ciudadanos y supondría una lacra para la innovación y el desarrollo digital en Europa.

El texto sobre el que está trabajando el Consejo europeo contiene incertezas y puertas
traseras que debilitan claramente la Neutralidad de la Red:

Article 3(3): Providers of electronic communications to the public, including providers of
internet access services, shall be free to enter into agreements with end-users, including
and/or providers of content, applications and services to deliver a service other than
internet access services, which requires a specific level of quality. (emphasis added)

La incapacidad para definir claramente cuales son esos "otros" servicios, abre las puertas
a modelos de negocio discriminatorios, por ejemplo, mediante el desarrollo ad-hoc de
servicios que requieran esa mayor calidad con el fin de justificar la necesidad de acceso
a internet de mayor velocidad.

*Xnet**-**along with other European **civil society **organi**s**ations fighting to ensure
the defense of **the **Net **N**eutrality*in the context of the European Union's digital
policies-*condemns the **vassal **role **of many government towards**the
telcos**'**lobbies*. In our case,the Spanish government's roleis being played by Pilar del
Castillo, Parliament rapporteur on this subject.

The fact that the rapporteuris Spanishmakesour responsibility even greater when
voicingpressure form civil society so that the interests of both citizens and innovation
are defended, instead of the bottlenecks created byand for the big monopolies.

As usual in the field of legislation concerning the digital era;Spain's position with
PPSOE – and the PP in absolute majority – is contrary to the Net Neutrality, defending
anachronistic and shortsighted points of view that basically represent
Telefónica'sposition and interests.

Just one month ago, we celebrated in social networks the historic victory, after years of
public pressure, of the FCC'sdecision to legally protect the Net Neutrality in the United
States. This meant that the Internet mustbe considered a public good preventing any
corporation or government to prioritise who and how can have access to it.

We can not allow the European Union to do just the opposite.

The recent US commitment to defend the Net Neutrality ensures that they will be at the
forefront of the development of an open online economy. A*European legislation allowing
the payment for prioriti**s**ation**,**attempts against **citizens'**rights and would be a
burden for innovation and digital development in Europe*.

The text on which the European Council is working on contains uncertainties and loopholes
that clearly undermine the Net Neutrality:

The inability to clearly define which are those “other” services, opens the door to
discriminatory business models, for example, by developing ad-hoc services that require
thatspecificquality in order to justify the need ofaccess to afaster Internet.
