[Open-Legislation] Study of the French OD public policy

Hello Everyone,

	For those who could be interested, you will find enclosed a working paper on the French policy of open data, done between February and mid May 2012 for a Science Po course on public action. This public policy study first questions the model of state data opening, then focuses on implementation. Using these two theoretical outlooks the main findings are the following:

	- The French policy of open data is still relying on the model of data communication to the public settled in 1978. This model was mixed with the requirements of several European directives. It settles a "right of communication" and is acting against monopols of re-use, rather than the opening of datas. The result of this situation is that some ministries were dued to open data, others not, and most of them are still selling informations.

	- The problem of opening datas and political solutions were already discussed in 2006/8 (streams) but the opportunity to launch the policy appeared in 2010. The Prime Minister decided not to break the legal situation and not to force administrations to publish their datas. He created a third part institution in charge of discussing with administrations the opening (policy design).

	- The implementation focused on re-use and the economic aspect. The state was rather an incentive for re-use than a guarantee of access or  transparency. Despite some successes, the policy did not realize the goals it had defined for itself. It can be accounted for a kind of opposition from the administration, a concurrency between the state and local governments, for the initial policy design.
